Q: Does the additional 2 year waiver exempt limited English proficient students from testing?
A: The Guidelines for Testing Limited English Proficient Students are still in effect. These students may be exempt from statewide testing for up to two years from the date of initial enrollment. The waiver allows students who are tested but score below Level III due to insufficient English language proficiency to still be promoted.
Q: Is the waiver automatic?
A: There is no automatic waiver. It may be requested by school personnel or parents who believe that a student scored beow level III due to insufficient English language proficiency.
Q: What goes into the instructional portfolio?
A: Local districts determine the content of the portfolio. Suggestions are provided above. The portfolio should be an ongoing collection of documentation which can be utilized when needed by a review committee.
Q: What are the criteria the student must meet to be promoted?
A: Local districts determine the criteria that define "adequate progress in academic areas." The review committee then decides if the student has met the criteria.
Q: What happens if a limited English proficient student arrives in the middle of the year and there are insufficient academic records?
A: Local districts need to utilize a variety of assessments, including native language assessments when appropriate, along with statements from teachers regarding the student’s academic performance.
Q: Who serves on the waiver committee?
A: The local district determines the composition of the committee. It may be the same as the review committee but should include someone who has experience working with limited English proficient students. The committee makes recommendations to the principal.
Q: Is there a review process for Gateway 4 (high school graduation)?
A: There is no review process for limited English proficient students at Gateway 4. These students are required to meet all requirements for graduation.
