PUBLIC NOTICES 2011-12 :: OCTOBER 4, 2011


Notice is hereby given that the North Carolina Department of Public Instruction (NCDPI) will submit a request for a waiver of Section 421(b) of the General Education Provisions Act - also know as the "Tydings Amendment" - as it affects the authority of the NCDPI and its sub-recipients to obligate Fiscal Year 2009 regular and American Recovery and Reinvestment Act (ARRA) funds after Sept. 30. Specifically, the NCDPI is requesting that the authority to obligate funds for the state-administered Elementary and Secondary Education Act programs listed below be extended to Sept. 30, 2012.

  • CFDA 84.389A Title I, Part A Grants to Local Educational Agencies (Recovery Act)
  • CFDA 84.186A Title IV, Part A Safe and Drug Free Schools and Community Grants

Continued use of available funds will allow the NCDPI and local education agencies to retain personnel who are vital to carrying out ongoing educational reform activities initiated because of the infusion of resources under the ARRA. The state believes that the requested waiver will increase the quality of instruction for students, improve the academic achievement of students, and continue to assist the same populations served by the programs for which the waiver is being requested in accordance with applicable program requirements.
