NORTH CAROLINA DEPARTMENT OF PUBLIC INSTRUCTION REQUESTS WAIVERS TO TITLE I, PART A SCHOOL IMPROVEMENT GRANTS SECTION 1003(G) TYDINGS AMENDMENT

Notice is hereby given that the North Carolina Department of Public Instruction (NCDPI) will submit a request for a waiver of section 421(b) of the General Education Provisions Act (GEPA) (the “Tydings Amendment”) as it affects the authority of NCDPI and its sub-recipients to obligate fiscal year FY 2015 and FY 2016 School Improvement Grant (SIG) 1003(g) funds after Sept. 30, 2017 (FY15 Funds) and Sept. 30, 2018 (FYI 16 Funds).

Specifically, NCDPI is requesting that the authority to obligate funds for the state-administered Elementary and Secondary Education Act (ESEA) programs listed below be extended to Sept. 30, 2021.

CFDA 84.377A School Improvement Grants
This request to extend the waiver, submitted pursuant to section 9401(d)(2) of the ESEA, would permit NCDPI in accordance with criteria NCDPI develops, to identify and allow local education agencies (LEAs) and charters, who apply for, and are awarded a SIG Grant with Cohort 4 SIG schools additional time to expend remaining FY 2015 and FY 2016 SIG funds in those schools.

In particular, the extension would allow Cohort 4 Tier I or Tier II schools with unexpended FY 2015 and/or FY 2016 funds to use those funds to continue to implement a SIG model through the 2020-21 school year, if the schools satisfy criteria developed by the state education agency. Continued use of available funds will allow LEAs to fully implement one of the rigorous intervention models to significantly turnaround the awarded school.

The state believes that the requested waiver will increase the quality of instruction for students, improve the academic achievement of students, and continue to assist the same populations served by the programs for which the waiver is being requested in accordance with applicable program requirements.

Waiver 1: Period of availability of FY 2015 funds waiver
Note: This waiver only applies to FY 2015 funds for the purpose of making three- to five-year awards to eligible LEAs. 
 In order to extend the period of availability beyond September 30, 2017, waive section 421(b) of the General Education Provisions Act (20 U.S.C. § 1225(b)) to extend the period of availability of FY 2015 school improvement funds for the SEA and all of its LEAs to September 30, 2021.

Waiver 2: Period of availability of FY 2016 funds waiver
Note: This waiver only applies to FY 2016 funds for the purpose of making three- to five-year awards to eligible LEAs. 
 In order to extend the period of availability beyond September 30, 2018, waive section 421(b) of the General Education Provisions Act (20 U.S.C. § 1225(b)) to extend the period of availability of FY 2016 school improvement funds for the SEA and all of its LEAs to September 30, 2021.
